ÍNDICE DE RENÚNCIA E REPRESENTAÇÃO DOS PROCESSOS DE VIOLÊNCIA DOMÉSTICA DA COMARCA DE FREDERICO WESTPHALEN/RS
A violência contra a mulher no
âmbito doméstico, sempre foi uma triste
realidade enfrentada em nossa sociedade,
ao passo que se viu necessária a criação de
uma lei específica que tratasse da punição e
coibisse toda e qualquer forma de violência e
discriminação contra a mulher. Com a Lei Maria
da Penha a mulher passou a ter maior proteção
e segurança, contudo cabe à vítima da violência
familiar, a escolha de seguir ou não com o
processo criminal. O presente trabalho visa,
portanto, responder a seguinte problemática:
Qual o índice de renúncia e representação nos
processos de violência doméstica da Comarca de
Frederico Westphalen/RS? Objetivando assim,
analisar qual tem sido as escolhas feitas pelas
vítimas de violência doméstica desta Comarca,
quanto ao seguimento a ser dado ao processo.
Para tanto a presente pesquisa, utilizar-se-á de
uma metodologia baseada no método dedutivo,
de abordagem quantitativa. Realizada com
o desenvolvimento do Projeto Integrado de
Atendimento às Famílias Vítimas de Violência
Intrafamiliar, espera-se diagnosticar a maior
incidência quanto aos institutos da renúncia e
da representação, de modo que seja possível
vislumbrar o reflexo que a Lei Maria da Penha
vem causando em nossa comunidade. Assim,
considera-se renúncia a abdicação do direito
da vítima processar o agressor, o que acarreta
em imediata extinção do processo. Enquanto a
representação é a manifestação expressa da
vítima em querer dar início à ação penal. Inferese,
então, ser de suma importância a análise
das escolhas realizadas pelas vítimas de
violência doméstica da Comarca de Frederico
Westphalen/RS.

Abstract:
Violence against women
concerning the domestic sphere has always been a sad reality faced in our society,
whereas it was necessary to create a specific law to deal with punishment and restrained
any form of violence and discrimination against women. With Maria da Penha law,
women have had better protection and security, but it is up to the victim who has
suffered the family violence to choose whether or not to follow the criminal process.
The present paper aims to answer the following issue: What is the rate of renunciation
and representation in the domestic violence processes of Frederico Westphalen /
RS county? In order to analyze the choices made by the victims of domestic violence
in such County, regarding the follow-up to be given to the process. Considering the
present research, it will be uses a methodology based on the deductive method, of
quantitative approach. It was held in the development of the Integrated Project to
Assist Families Victims of Intrafamily Violence, it is expected to diagnose the highest
incidence of renunciation and representation institutes, so that it is possible to glimpse
the reflection which Maria da Penha Law has caused in our community. Thus, it is
considered waiver the abdication of the right from the victim to prosecute the aggressor,
which entails the immediate extinction of the process. While the representation is the
express manifestation of the victim willing to initiate the criminal action. The analysis
of the choices made by the victims of domestic violence in the District of Frederico
Westphalen / RS is considered of crucial importance.
