A entrada em vigor do acordo de livre comércio entre a União Europeia e o Mercosul implicará a proteção de aproximadamente 350 indicações geográficas. Um conjunto dessas indicações geográficas corresponde a nomes não geográficos, sendo essa uma das razões pelas quais elas não estão em conformidade com a Lei nº 9.279, de 1996. O trabalho sugere uma reflexão sobre uma alteração dos arts. 177 e 178 da Lei de Propriedade Industrial para permitir o registro de indicações geográficas de nomes não geográficos.

  • Abstract: The entry into force of European Union and the Mercosur free trade agreement will imply the protection of approximately 350 geographical indications. A set of such indications does not correspond to non-geographic names, being one of the reasons for which they are not in conformity with the Brazilian Industrial Property Law number 9279 of 1996. This paper intends to discuss a possible alteration on articles 177 and 178 of the referred law which may allow the registration of geographical indications of non-geographical names.
