INCLUSÃO TERRITORIAL: EFETIVIDADE DO DIREITO VIA PERSPECTIVA ANTROPOLÓGICA
Busca-se um referencial teóricometodológico
que estabeleça uma relação
entre a ausência de estudos antropológicos
e a ineficácia dos métodos de inclusão
territorial em Florianópolis. Serão abordados
os instrumentos legais para a regularização
fundiária e escolhas realizadas pelo Poder
Público na implementação de políticas
públicas. O artigo aborda questões acerca
da ocupação das terras no Brasil traçando
relação entre o histórico e a necessidade da
reflexão antropológica e propõe a utilização de
conceitos ligados à política urbana no Brasil. A
metodologia empregada é a qualitativa baseada
em revisão bibliográfica, pesquisa documental
e observação direta da realidade, unindo a
legislação e os instrumentos aplicados. O
estudo contribui para o conhecimento dos meios
de regularização fundiária, sob a perspectiva
de um viés antropológico, considerando as
especificidades dos assentamentos para melhor
compreender as necessidades dos envolvidos
e, consequentemente, atingir a efetividade da
legislação existente.

Abstract:
We seek a theoreticalmethodological
reference that establishes a
relation between the absence of anthropological
studies and the inefficacy of the methods
of territorial inclusion in Florianópolis. The
legal instruments for land regularization
and the choices made by the government in
the implementation of public policies will be
addressed. The article deals with questions
about land occupation in Brazil, drawing a
relation between the history and the need for
anthropological reflection and proposes the use
of concepts related to urban politics in Brazil.
The methodology used is the qualitative one
based on bibliographical revision, documentary
research and direct observation of the
reality, uniting the legislation and the applied
instruments. The study contributes to the
knowledge of the means of land regularization,
from the perspective of an anthropological bias,
considering the specificities of the settlements to better understand the needs of those
involved and, consequently, to achieve the effectiveness of existing legislation.
