INCENTIVOS PÚBLICOS A PRESERVAÇÃO E RECUPERAÇÃO DA VEGETAÇÃO NATIVA NA PROPRIEDADE FAMILIAR RURAL DO RS: PROPOSTAS PARA REGULAMENTAÇÃO DO CÓDIGO ESTADUAL DE MEIO AMBIENTE DE 2020
O presente trabalho tem por objetivo geral elaborar propostas para regulamentação do atual Código de Meio Ambiente do Rio Grande do Sul - Lei nº 15.434/ 2020, a respeito da concessão de incentivos à preservação e recuperação da vegetação nativa na propriedade familiar rural do Estado, como sendo uma prestação de serviços ambientais ao contexto geral das coletividades e a promoção do desenvolvimento sustentável rural e urbano. Trata-se de um trabalho de cunho interdisciplinar e transdisciplinar entre as áreas do desenvolvimento, direito, técnica ambiental e gestão da propriedade familiar rural do Rio Grande do Sul. Posteriormente, tais propostas serão encaminhadas a um Deputado Estadual, para elaborar um projeto de lei, que vai originar uma lei estadual. Da mesma forma, o projeto sendo aprovado na Assembleia Legislativa, deverá ser encaminhado ao Governador do Estado para sanção ou veto. Portanto, o resultado do presente estudo trará importantes contribuições para a regulamentação de políticas estaduais, dotadas de incentivos públicos que venham fomentar a preservação e recuperação ambiental da propriedade familiar rural, para além das exigências mínimas já estabelecidas em norma e, ao mesmo tempo, uma contribuição significativa ao desenvolvimento sustentável.

Abstract:
The presente work has as general purpose to elaborate proposals for the current Environmental Code of Rio Grande do Sul – Law No. 15.434/2020, about concession of incentives to preservation and recovery of native vegetation in the rural family property of the State, as a provision of environmental services to the collectivities’ general context and the promotion of rural and urban sustainable development. It is an interdisciplinary and transdisciplinary work between the areas of development, law, environmental technique and management of rural family property in Rio Grande do Sul. Subsequently, such proposals will be sent to a State Deputy to authored a bill that will originate a state law. In the same way, the bill been approved by the Legislative Assembly, it must be sent to the State Governor for sanction or veto. Therefore, the result of the present research will bring important contributions for the regulation of the state politics, endowed with public incentives that will encourage the environmental preservation and recovery of rural family property, beyond the minimum requirement already establiched in law and, at the same time, a significant contribution to sustaintable development.
