INAPLICABILIDADE DO PRINCÍPIO VITMODOGMATICO NOS CRIMES DE ESTUPRO
O estudo a seguir contempla a
culpabilização da mulher no crime de estupro,
previsto no artigo 213 do Código Penal. Houve
a análise de estudos antigos bem como atuais
sobre o comportamento de estupradores,
lembrando que o crime foi se caracterizando
durante a história. A metodologia de pesquisa
utilizada foi a leitura de livros e artigos em
linhas similares, vídeos, pesquisa com a
população, dados estatísticos e a observação
de comportamento midiático. Comparando a
realidade de outros países, nossos julgados e
sentenças, foi possível traçar o comportamento
do nosso direito acerca desse crime. A busca por
dados obteve como resultado que o imperante
no Brasil é uma grande culpabilização das
vítimas por estereótipos sociais, quando na
verdade foi provado que as mais frequentes
não são mulheres com roupas consideradas
inadequadas ou de batom forte, as vítimas
recorrentes são as que conhecem seu agressor,
confiam e convivem com o mesmo. Foi
demonstrado que a cultura do estupro no Brasil
abafa o grito de socorro do sujeito passivo e
exalta seu agressor.

Abstract:
The following study contemplates a
blame of the woman in the crime of rape, foreseen
in article 213 of the Criminal Code. There has
been an analysis of ancient as well as current
studies on the behavior of rapists, reminding that
crime to be characterized throughout history. A
research methodology used to read books and
articles in lines, alternatively, research, statistics
and observation of media behavior. Comparing
the reality of other countries, our judgments and
sentences, it was possible to trace the behavior
of our right over crime. The search for data has
resulted in the prevailing non-Brazil is a great
blame of the victims for stereotypes, when in
fact it is proven that as more frequent are not
women with clothes considered inadequate or
strong lipstick, as recurring victims are as they
know His Aggressor, trust and live with it. It has
been shown that the culture of rape on Brazil
obliterates the cry of relief of the passive subject
and exalts his aggressor.
