Abstract: This article investigates the imputability of the murders of children in Brazilian indigenous communities, focusing especially on cases involving newborns with disabilities or twins. Through a bibliographical and documentary review, it analyzes the cultural, historical, and legal factors that permeate the practice and the challenges of reconciling cultural rights with the comprehensive protection of children's human rights. The anthropological bases of these practices, the role of the State, legislative gaps, and possible paths for public policies that are sensitive to cultural diversity but uncompromising in the protection of life are discussed. The study emphasizes the need for intercultural dialogue, education on human rights, and structured actions that promote the dignity and protection of indigenous children.
