IMPASSES REGULATÓRIOS NA SHARING ECONOMY: UMA ANÁLISE A PARTIR DO AIRBNB E SEUS EFEITOS NA RECONFIGURAÇÃO URBANA
O presente trabalho pretende estudar os impactos da acomodação turística a partir da plataforma Airbnb na reconfiguração urbana e quais as mais eficientes formas estatais e medidas regulatórias de adequá-la ao uso sadio da cidade. Para isso, faz-se um apanhado histórico do fenômeno da Sharing Economy, movimento no qual o Airbnb se enquadra, para estabelecer as principais teses de defesa e críticas relevantes ao modelo, além de retomar as mais relevantes formas classificatórias elencadas pela literatura especializada. Em seguida, discutem-se algumas propostas regulatórias pouco usuais, como a defesa da não regulação do Estado, a autorregulação e a legislação experimental. Por fim, analisam-se as experiências internacionais mais relevantes sobre o tema, nomeadamente Nova York, Barcelona e Berlim, com especial ênfase nos efeitos gerados na cidade pelo uso desenfreado da plataforma de hospedagem.

Abstract:
This work aims to study the impacts of tourist accommodation from the Airbnb platform on urban reconfiguration and which are the most efficient ways to adapt it to a healthy use of the city with state intervention and regulatory measures. To this end, a historical overview of the phenomenon of the Sharing Economy is made, a movement in which Airbnb fits in, to establish the main remarks of supporters and critics about this business model, in addition to resuming the most relevant classificatory forms listed by the specialized literature. Then, some unusual regulatory proposals are discussed, such as the defense of the non-regulation of the State, self-regulation and experimental legislation. Finally, the most relevant international experiences on the subject are analyzed, namely New York, Barcelona and Berlin, with special emphasis on the effects generated in the city by the unbridled use of the hosting platform.
