HISTÓRICO E SISTEMATIZAÇÃO DOGMÁTICA DO PRINCÍPIO DA LEGALIDADE: DO DIREITO PENAL DO TERROR AO DIREITO PENAL LIBERAL HUMANIZADO
O presente texto tem como objetivo analisar o escorço histórico da manifestação do poder punitivo no período precedente à sistematização dogmática do princípio da legalidade – que se perfez em 1801, por obra de Anselm von Feuerbach − com o afã de sobrelevar a importância do advento do citado princípio para o processo de humanização da repressão penal do Estado, por constituir, enquanto fenômeno jurídico e histórico, o momento do nascimento do período científico e humanitário do Direito Penal, denominado liberal, que põe termo ao precedente período do terror. Trata-se de pesquisa histórico-jurídica.

Abstract:
The present text aims to analyze the historical manifestation of the punitive power in the period preceding the dogmatic systematization of the principle of legality - which was completed in 1801, in the work of Anselm von Feuerbach - with the desire to emphasize the importance of the advent of this principle for the process of humanization of the State's criminal repression, for constituting, while a legal and historical phenomenon, the moment of the birth of the scientific and humanitarian period of criminal law, called liberal, that ends the previous period of the terror. This is about historical-juric research.
