• Abstract:

  This work presents a

  historiographic approach on the implementation

  of educational rights in the Brazilian Federal

  Constitutions since our first Constitution granted

  in 1824, a monarchical period in force, covering

  the other Constitutions until the so-called Citizen

  Constitution of 1988. Before the explanation of

  this historical route is made It is necessary to

  present the formative and evolutionary process

  of human rights, a process comprised of four

  specific generations called natural / civil rights, political rights and social rights and

  solidarity rights. With this theme we aim to analyze the historical course of the insertion

  of these rights with regard to education in the seven Federal Constitutions in force

  throughout the national political experience, as well as the Constitutional Amendment

  of 1969 and the implications of granting these rights to society. Starting from this

  analytical process, the work will approach the Constitutions in their different historical

  contexts and will approach the different compositions of constitutional texts related

  to the issue of education, emphasizing that in some Constitutions the retrocession in

  recognizing the right to education is noticeable, while in others we observe important

  achievements for the democratization of education in Brazil.
