HISTÓRIA DO DIREITO À EDUCAÇÃO NAS CONSTITUIÇÕES BRASILEIRAS: DE 1824 À CONSTITUIÇÃO DE 1988
O presente artigo tem por objetivo explorar o tema referente ao direito à
educação, com base nos dispositivos constitucionais. Com isso, pretende-se analisar
como o direito a educação vem sendo tratado pelas Constituições Brasileiras, desde
1824 até 1988. Aborda-se, inicialmente, o conceito e a evolução histórica da
educação, posteriormente, analisa-se, também, a evolução da educação em nosso
ordenamento jurídico. Para tanto, realizou-se uma revisão da literatura, buscando
captar a evolução histórica da educação em si e o contexto histórico em que a
educação foi concebida, implantada, desenvolvida e consolidada
constitucionalmente no Brasil. Além disso, todas as Constituições Brasileiras desde
1824 a 1988 foram analisadas no que tange os dispositivos que tratam sobre a
educação. Concluiu-se, que a Constituição Federal de 1988 estabelece a educação
como um direito fundamental e, por isso, tal direito goza de privilégios em nosso
ordenamento jurídico. A legislação, seja ela constitucional ou infraconstitucional, é
farta. No entanto, não é aplicada no sentido de garantir uma educação pública e de
qualidade para todos. Esse é o grande desafio do direito à educação: fazer com que
as prerrogativas inerentes a esse direito sejam postas em prática, alcançando-se o
objetivo básico da educação, que é proporcionar o pleno desenvolvimento da pessoa,
seu preparo para o exercício da cidadania e sua qualificação para o trabalho.

Abstract:
This article aims to explore the theme of the right to education, based on
constitutional provisions. The purpose of this study is to analyze how the right to
education has been treated by the Brazilian Constitutions from 1824 to 1988. The
concept of historical evolution of education is initially approached. It also analyzes
the development of education in our country legal order. Therefore, a review of the
literature was carried out, looking for a historical calendar of education itself and the
historical context in which the education projected, implanted, developed and
consolidated constitutionally in Brazil. In addition, all Brazilian Constitutions from
1824 to 1988 were analyzed in relation to the devices that deal with education. It
was concluded that the Federal Constitution of 1988 establishes a fundamental right
and, therefore, that right enjoys privileges in our legal system. Legislation, thus
constitutional or infraconstitutional, is full. However, it is not implemented without a
sense of security, a public publication and quality for all. This is the great challenge
of the right to education: make as if prerogatives inherent in this right are put into
practice, the objective is a basic objective of education, which is a project of full
development of the person, his preparation for the exercise of citizenship and your
qualification for the job.
