Abstract: We are experiencing a global financial crisis, as a result of the pandemic generated by COVID 19. Due to the increase in the quality and length of life of humanity, there was a need to adapt legislation to this new reality of life. And given the need to maintain the dignity of the human person in the elderly phase, Bill 3096/2019 was created, where the legislator deals with the institute called reverse mortgage, for the elderly, in order to allow people aged equal to or older 60 year olds can sell the house they live in without having to leave it, thus creating a new source of income. Guaranteeing social well-being and fulfilling the social function of the property. When taking out a reverse mortgage, the owner gives the property as collateral, in exchange for a monthly income for life, as if it were rent paid by the financial institution while the owner is alive. After the death of the owner, the financial institution will become the owner of that property. However, when agreeing to this contract, the property remains outside the assets left to heirs, as it becomes the property of the financial institution after the death of the contracting party. However, there is dissatisfaction with the acceptance of such a measure by family members, especially by children who are not concerned with the well-being of their parents, but rather with what their parents will leave as an inheritance to guarantee their well- being, but the heirs will not have rights to the assets owned by their predecessors, with the contract having been formalized in According to applicable law, there is nothing to question. It is concluded that the new figure is a skillful mechanism for the moment, as Brazil is going through major changes, such as social security reform and the increase in human life expectancy.
