Hermenêutica Filosófica e o Direito Brasileiro: conexões necessárias
a presente investigação visou apurar as possíveis e/ou necessárias interconexões havidas entre os postulados ontológico-hermenêuticos de Martin Heidegger e Georg Gadamer para com o Direito brasileiro. Para tanto, buscamos elucidar brevemente, via revisão bibliográfica, as teoria erigidas pelos autores alemães, para, sequencialmente, demonstrarmos, via revisão bibliográfica de autores nacionais e internacionais, e assim também por dedução, a aplicabilidade das referidas teorias na ciência jurídica em geral e no direito brasileiro em específico. Com este estudo, pudemos observar a nevrálgica relação que guarda e/ou deveria guardar a ciência jurídica com a ontologia heideggeriana e a hermenêutica gadameriana, posto que o Direito, enquanto ente intramundano, deve, por tal característica, igualmente submeter-se às teorias da ontologia em geral que, como se pôde concluir, se não forem consideradas pelos aplicadores do direito, podem fazer ruir todo um sistema contemporâneo-constitucional.

Abstract:
the present investigation sought for the possible and / or necessary interconnections existing between the ontological-hermeneutical postulates of Martin Heidegger and Georg Gadamer with Brazilian law. For this purpose, we seek to briefly elucidate, via bibliographic review, the theory developed by German authors, to sequentially demonstrate, via bibliographic review by national and international authors, and thus also by deduction, the applicability of the aforementioned theories in legal science in general and in Brazilian law in particular. With this study, we were able to observe the important relationship that legal science has and / or should keep with Heideggerian ontology and Gadamerian hermeneutics, since Law, as an intramundane entity, must, by this characteristic, also submit to the theories of ontology in general, whose which, if not considered by the enforcers of law, can bring down an entire contemporary-constitutional system.
