HERANÇA INVISÍVEL: UM ESTUDO SOBRE TRANSGERACIONALIDADE NOS PROCESSOS DE DESTITUIÇÃO FAMILIAR NA VARA DA INFÂNCIA DA ADOLESCÊNCIA E DO IDOSO DE CAMPO GRANDE-MS

Este trabalho tem como foco a análise da transgeracionalidade em casos de destituição do poder familiar na Vara da Infância, Adolescência e do Idoso de Campo Grande-MS. A pesquisa parte da compreensão de que traumas, violências e negligências vivenciados por uma geração podem se repetir na seguinte, perpetuando ciclos de sofrimento psíquico que impactam o exercício da parentalidade. A partir de uma perspectiva psicanalítica e da Psicologia Jurídica, buscou-se identificar, por meio de análise documental de processos judiciais, elementos que evidenciem a transmissão psíquica entre gerações. Foram examinados laudos psicológicos e relatórios técnicos constantes nos autos, permitindo compreender como a herança psíquica influencia as dinâmicas familiares e se articula às decisões jurídicas. Os resultados indicam que a transgeracionalidade se manifesta de diferentes formas, seja na repetição de comportamentos violentos, na negligência ou em padrões de abandono, revelando a importância da atuação interdisciplinar entre Psicologia e Direito. A identificação desses padrões pode auxiliar na ruptura de ciclos nocivos e subsidiar práticas mais efetivas no campo da Psicologia Jurídica, contribuindo para a proteção integral de crianças e adolescentes.

  • Abstract: This study focuses on the analysis of transgenerationality in cases of termination of parental rights in the Juvenile Court of Campo Grande – MS, Brazil. The research is based on the understanding that traumas, violence, and neglect experienced by one generation can be repeated in the next, perpetuating cycles of psychological suffering that affect parenting practices. From a psychoanalytic and legal psychology perspective, a documental analysis of judicial processes was conducted in order to identify elements that demonstrate the psychic transmission across generations. Psychological reports and technical documents from the case files were examined, allowing an understanding of how psychic inheritance influences family dynamics and relates to judicial decisions. The findings indicate that transgenerationality manifests in different forms, such as repeated violent behaviors, neglect, or abandonment patterns, highlighting the importance of an interdisciplinary approach between Psychology and Law. It is concluded that identifying these patterns can support the disruption of harmful cycles and provide more effective practices in Legal Psychology, contributing to the full protection of children and adolescents.
