HABEAS CORPUS 143.641 E OS PROBLEMAS DO ENCARCERAMENTO FEMININO NO BRASIL
O presente trabalho buscou analisar quais foram os fundamentos jurídicos do Habeas Corpus Coletivo 143.641, concedido pelo STF, que abordou o caso Alyne Pimentel, considerada a primeira e única denúncia acolhida pelo Comitê para a Eliminação de Todas as Formas de Discriminação Contra a Mulher (CEDAW) e que responsabilizou o Brasil por uma morte materna evitável. Trata, ainda, dos problemas do encarceramento feminino no Brasil, demonstrando um pouco da realidade deplorável vivenciada por milhares de mulheres, e até mesmo por seus filhos, e a dificuldade que é a gravidez no cárcere, além de fazer uma análise da efetiva implementação do Habeas Corpus em questão.

Abstract:
The present work aimed to analise which were the legal fundaments from the collective Habeas Corpus 143.641 granted by the STF, approaching Alyne Pimentel’s case, that was the first and only claim admitted by the Committee on the Elimination of Discrimination against Women (CEDAW) that held Brazil accountable for an avoidable maternal death; the problems of feminine incarceration in Brazil, demonstrating a little from the deplorable reality lived by thousands of women and even by their children and the difficulty in pregnancy while incarcerated, in addition to the implementation of the Habeas Corpus in point.
