GUERRA NA UCRÂNIA: DIREITOS HUMANOS SOB ATAQUE E A IMPORTÂNCIA DO DIREITO HUMANITÁRIO

O presente trabalho tem por objetivo analisar as implicações do conflito Rússia-Ucrânia para os Direitos Humanos, com foco nas violações documentadas, no Direito Internacional aplicável e nos mecanismos de responsabilização, destacando o papel do Direito Internacional Humanitário neste contexto. Será utilizada a pesquisa bibliográfica baseada em artigos acadêmicos, análise de leis, convenções, protocolos, resoluções e documentos. Assim, será abordado como se desenrolou o conflito no tempo sob o ponto de vista histórico, político e jurídico. Além disso, discute os desafios jurídicos para a responsabilização dos perpetradores, as implicações do conflito para o Direito Internacional e o papel do Direito Humanitário realizado por instituições como o Comitê Internacional da Cruz Vermelha (CICV) e do Alto Comissariado das Nações Unidas para os refugiados (ACNUR). Por fim, será concluído que a invasão da Rússia na Ucrânia representa uma grave ameaça aos Direitos Humanos e ao Direito Internacional, exigindo uma resposta coordenada e efetiva da comunidade internacional, com os mecanismos normativos disponíveis, seja para garantir a responsabilização dos culpados, seja para apoiar as vítimas do conflito através do Direito Internacional Humanitário (DIH).

  • Abstract: The present work aims to analyze the implications of the Russia-Ukraine conflict for Human Rights, focusing on documented violations, applicable International Law and accountability mechanisms, highlighting the role of International Humanitarian Law in this context. Bibliographic research based on academic articles, analysis of laws, conventions, protocols, resolutions and documents will be used. Thus, it will be addressed how the conflict unfolded in time from the historical, political and legal point of view. In addition, it discusses the legal challenges to the accountability of perpetrators, the implications of the conflict for international law, and the role of humanitarian law carried out by institutions such as the International Committee of the Red Cross (ICRC) and the United Nations High Commissioner for Refugees (UNHCR). Finally, it will be concluded that Russia's invasion of Ukraine represents a serious threat to Human Rights and International Law, requiring a coordinated and effective response from the international community, with the normative mechanisms available, both to ensure accountability for the culprits and to support the victims of the conflict through international humanitarian law (IHL).
