Gestão de antineoplásicos oriundos de demandas Judiciais em um hospital terciário
As demandas judiciais para tratamento oncológico cresceram exponencialmente nos últimos anos. Diante dos seus efeitos no financiamento do sistema de saúde, o presente trabalho tem por objetivo descrever o perfil das demandas judiciais para fornecimento de antineoplásicos em um hospital universitário terciário. No período de estudo foram analisados dados de 112 ações judiciais, referentes aos pacientes que utilizaram antineoplásicos no período de 2012 a 2016, com os processos disponíveis no site da Justiça Federal. Observou-se um aumento de quase 10 vezes na demanda por antineoplásicos ao longo do período. Verificou-se que o tempo médio decorrido entre o início da ação até a dispensação ao paciente foi de 136 dias. O número de fármacos demandados foi de 22, fornecidos por diferentes vias, verificando-se duplicidade de fonte de provisão em 29,5% das ações. Em relação ao custo de tratamento, foram gastos R$ 8.860.773,74 no período, principalmente para custeio de ações envolvendo bortezomibe, trastuzumabe, brentuximabe, cetuximabe, abiraterona, temozolomida, cabazitaxel e pertuzumabe. Observou-se que, após o término dos tratamentos, permaneceu na instituição o equivalente a R$ 3.818.504,53, na forma de frascos e/ou recurso financeiro. Portanto, torna-se visível o aumento da via judicial para fornecimento de antineoplásicos, bem como de que medidas devem ser adotadas para melhorar a gestão da assistência oncológica.

Abstract:
Judicial demands for cancer treatment have grown exponentially in recent years. In view of its effects on the health system financing, this study aims to describe the profile of the legal demands for the supply of antineoplastics in a tertiary university hospital. During the study period, 112 lawsuits data were analyzed, referring to patients who used antineoplastic drugs in the period from 2012 to 2016, with the processes available in the website of the Federal Court. It was observed a nearly 10-fold increase in demand for antineoplastics over the period. It was verified that the average time from the lawsuit beginning until the dispensation to the patient was 136 days. The number of drugs requested was 22, provided by different sources, verifying the provision source duplication in 29.5% of the lawsuits. Regarding the treatment costs, R$ 8.860.773,74 were spent in the period, mainly for financing court lawsuits involving bortezomib, trastuzumab, brentuximab, cetuximab, abiraterone, temozolomide, cabazitaxel and pertuzumab. It was observed that, after the treatments completion, the equivalent of R$ 3.818.504,53 remained at the institution in the form of flasks and/or financial resources. Therefore, it is possible to see the increase in the judicial means for the supply of antineoplastics, and that measures should be taken to improve the management of oncological assistance.
