GERAÇÃO DISTRIBUÍDA: LEGISLAÇÃO REGULATÓRIA E BENEFÍCIOS AOS CONSUMIDORES PELA COMPENSAÇÃO DE ENERGIA
Este artigo apresenta as características e requisitos que os consumidores e geradores de energia devem ter para se enquadrar na Geração Distribuída - GD. Busca-se a interpretação de legislação do setor elétrico brasileiro, com maior ênfase nas normativas próprias para a Geração Distribuída, em especial a Resolução Normativa 482 de 2012 promulgada pela Agência Nacional de Energia Elétrica - ANEEL, posteriormente atualizada pela Resolução Normativa 687 de 2015. Nesse panorama, pretende-se ampliar os conhecimentos do tema, possibilitando se colocar em prática na sociedade. A base legal é relativamente nova e, devido à lacuna de esclarecimento das possibilidades dos consumidores/geradores de energia elétrica se enquadrarem na GD, o momento é oportuno para desenvolver o tema. Com a GD, os consumidores podem gerar a própria energia elétrica, injetar no sistema de distribuição e compensar no consumo, inclusive tendo créditos que poderão ficar à disposição por até 60 meses. Este trabalho teve como objetivos norteadores descrever os mercados de energia elétrica existentes no Brasil, as legislações que os embasam e identificar os consumidores e geradores que podem beneficiar-se da GD.

Abstract:
This research presents the characteristics and requirements that Energy consumers and generators must have in order to fit into the category of Distributed Generation – DG. It aims for the legal interpretation of the Brazilian electrical sector, focusing on the Distributed Generation norms, specially the National Agency for Electric Energy – ANEEL’s Normative Resolution 482/2012, updated afterwards by the Normative Resolution 687/2015. Furthermore, it intends to broaden the theme’s comprehension, making it possible for the society to put the referred knowledge into practice. The legal basis is relatively new and, because of the legal gap related to the energy consumers/generators’ possibilities of being framed as Distributed Generation, it is high time to have the theme’s developed. With DG, consumers can generate its own electrical power, insert it into the distribution system and compensate its consumption, moreover, having credits available for up to 60 months. This work had as objective to describe the existing energy markets in Brazil, its legal fundaments and to identify consumers and generators that could be benefited from DG.
