GENOCÍDIO: HISTÓRIA, CONCEITO E TRATAMENTO JURÍDICO

Este trabalho tem como objetivo, por meio do método de abordagem indutivo, pesquisa qualitativa e técnica de pesquisa bibliográfica, identificar e analisar a origem histórica e da nomenclatura, bem como conhecer o tratamento jurídico adota no Brasil e Tribunal Penal Internacional para esse crime. E, com essa compreensão, buscar-se-a, entender o conceito, os estágios da prática criminosa. E, diante dessas conclusões entender melhor esse fenômeno e, pelo menos, quais são os principais casos mencionados pela doutrina, quem são os grupos protegidos e suas características e quais as críticas da doutrina sobre a escolha do conceito de genocídio. E, por conseguinte, entender os elementos constitutivos do tipo incriminador.

  • Abstract: This work aims, through the inductive approach method, qualitative research and bibliographical research technique, to identify and analyze the historical origin and nomenclature, as well as to understand the legal treatment adopted in Brazil and the International Criminal Court for this crime. And, with this understanding, we seek to understand the concept, the stages of criminal practice. And, given these conclusions, better understand this phenomenon and, at least, what are the main cases mentioned by the doctrine, who are the protected groups and their characteristics and what are the criticisms of the doctrine regarding the choice of the concept of genocide. And, therefore, understand the constituent elements of the incriminating type.
