EXPLORACIÓN CRÍTICA JURÍDICA PSICOTERAPÉUTICA DEONTOLÓGICA A LA ESTRUCTURA DE REHABILITACIÓN GENÉRICA PARA ADICCIONES DE ECUADOR

El objetivo de la presente investigación se centra en ejecutar una breve exploración crítica jurídica psicoterapéutica deontológica a la estructura de rehabilitación genérica para adicciones de Ecuador, debido a la enorme problemática del consumo de sustancias psicoactivas. El País al mantener escasas infraestructuras encaminadas al tratamiento para consumidores de spa, acarrea como consecuencia alarmantemente, la proliferación de carácter privado de los denominados “Centros de Tratamiento para Personas con Consumo Problemático de Alcohol y Otras Drogas – CETAD”, históricamente conocidos como comunidades terapéuticas o clínicas, pero en realidad son lugares donde existe una profunda violación a derechos humanos, a normas jurídicas estatales y de su propio funcionamiento, pues son reguladas por la Agencia de Aseguramiento de la Calidad de Salud y Medicina Prepagada (ACCES), sumado a una evidente carencia de ética, moral, profesionalismo y hasta humanidad, de quienes laboran en estos establecimientos carentes de deontología e inclusive bioética. La metodología empleada fue de carácter investigativo bibliográfico, donde se realizó una búsqueda de las principales publicaciones propuestas sobre adicciones, psicoterapia, ejecutándose además una detenida selección de algunos de los primordiales trabajos que contenían elementos legales que protegen la integridad humana, psíquica y física del adicto o consumidor, adicionalmente de contener un enfoque patológico. Como resultado, los propios estudios expresados por el estado indican que existe un porcentaje extremadamente elevado al incumplimiento de normativas éticas, legales constitucionales e institucionales en el modelo generalizado para adicciones de Ecuador. Como conclusión es posible citar, que es trascendental una intervención internacional al sistema de salud mental de este país, pues la corrupción y falta de visión de los distintos gobiernos durante décadas, a deteriorado esta estructura que forma parte del engranaje del sistema de políticas y de salud pública.

  • Abstract: The objective of this research focuses on conducting a brief critical legal-psychotherapeutic-ethical examination of the generic addiction rehabilitation structure in Ecuador, due to the enormous problem of psychoactive substance use. The country's scarce infrastructure for spa treatment has resulted in the alarming proliferation of private "Treatment Centers for People with Problematic Alcohol and Other Drug Use - CETAD," historically known as therapeutic communities or clinics. These centers actually violate human rights, state legal norms, and their own operations, as they are regulated by the Agency for Quality Assurance in Health and Prepaid Medicine (ACCES). This is coupled with a clear lack of ethics, morals, professionalism, and even humanity among those who work in these establishments, which lack professional ethics and even bioethics. The methodology employed was bibliographic research, which included a search of the main proposed publications on addictions and psychotherapy. A careful selection was also made of some of the most important works that contained legal elements protecting the human, psychological, and physical integrity of the addict or consumer, in addition to containing a pathological approach. As a result, the studies reported by the state indicate an extremely high percentage of noncompliance with ethical, legal, constitutional, and institutional regulations in the generalized model for addictions in Ecuador. In conclusion, it can be stated that international intervention in this country's mental health system is crucial, as corruption and lack of vision on the part of various governments over decades have deteriorated this structure, which is integral to the machinery of the public health and policy system.
