Abstract: ABSTRACT. The Amendment to the Complaint concerns the addition or addition of new elements to the Process or Main Action. The Principle of “In Dubio pro Reo” expresses that if there is doubt in the Criminal Procedure due to lack of evidence, the Judge's interpretation must be in favor of the accused. The Principle of Presumed Guilt is based on attributing the causes of the illicit act to someone's malpractice, imprudence and negligence for the given harmful practice: Simple Presumption, without the need to prove it. This last Principle is theoretically said to not be accepted in Law, especially in Brazilian Criminal Law. However, in our Jurisprudence there are many Decisions and Decisions in Appeals with favorable results for the appellants; mainly in Sentences involving Traffic Accidents and Crimes. This work aimed to evaluate different stages in an Action to Add to the Complaint presented by the representative of the Public Prosecutor's Office against two defendants who witnessed an accident involving a motorcycle driver with a fatal victim. The allegation in the request for addition to the Complaint was that they should be imputed under art. 312 of the Brazilian Traffic Code for helping the driver of the car to remove the victim from the trunk of the car and drag him to a nearby banana plantation. without there being concrete evidence of this accusation in the records. The defense of the accused, unsatisfied with allegations without evidence in the case file, argued for Impununciation and was accepted by the court based on the Principles of “In Dubio Pro Reo and/or Presumed Guilt in Criminal Law”. In addition, propose defense action strategies in similar cases based unduly on these Principles and care for Law Operators to avoid errors and misinterpretations without evidence that are subject to impeachment or reformed or annulled sentences in Criminal Law.
