ENTRE O SENSÍVEL E O INTELIGÍVEL – UMA ANALOGIA DA ALEGORIA DA CAVERNA DE PLATÃO APLICADA AO PROCESSO PENAL.
O presente artigo se debruça sobre a relação entre o processo penal e os direitos fundamentais, utilizando a título de analogia A República de Platão no capítulo VII alegoria da caverna, instituindo entre os dois mundos sensível e inteligível. O trabalho não tem o objetivo de exaurir o tema, porém, propõe a nos levar a fazer algumas reflexões sobre o contexto atual do processo penal e como podemos elevar essa lei infraconstitucional a máxima eficácia juntamente aos direitos humanos e tratados internacionais já ratificados. Por tal maneira que utilizamos aqui a alegoria da caverna de Platão, uma vez que, nesse capitulo conseguimos empregar vários elementos do contexto histórico e trazer para os dias atuais diferentes interpretações, que nos remete visualizar maneira mais filosófica e interpretativa a proposta desse estudo. Principalmente no tocante a relação feita entre os mundos: sensível e inteligível, a fim de, comparar o processo penal e como podemos fazer a sua passagem, saída da caverna, obtendo a máxima efetividade dos direitos fundamentais, dessa premissa realçar dentro do procedimento a dignidade da pessoa humana como forma/modelo de um processo constitucional e fundamentalista.

Abstract:
This article focuses on the relationship between criminal procedure and fundamental rights by using an analogy of that allegory of the cave stated in The Republic of Plato in Chapter VII, from which establishes two sensible and intelligible worlds.
The work does not intend to exhaust the subject, however, it proposes some reflections on the current context of the criminal process and how it is possible to elevate this infra-constitutional law to maximize effectiveness along with already ratified human rights and international treaties.
Thus, we use Plato´s cave allegory in this chapter in order to apply various elements of the historical context and bring to the present day different interpretations, which leads us to visualize the purpose of this study in a more philosophical and interpretative way.
Especially regarding the relationship proposed between the worlds: sensitive and intelligible, in order to compare the criminal process and how we can produce its passage of leaving the cave for obtaining the maximum effectiveness of fundamental rights, from this premise to enhance dignity within the procedure of the human person as a form/model of a constitutional and fundamentalist process.
