ENTRE O FATO E A FANTASIA: A COMISSÃO MUNICIPAL DA VERDADE DE JUIZ DE FORA E A OBRA 1984, DESFAZENDO A ILUSÃO POR TRÁS DOS REGIMES DITATORIAIS
O artigo realizará uma análise crítica
e contrastual entre a obra distópica 1984 e
depoimentos concedidos à Comissão Municipal
da Verdade de Juiz de Fora de indivíduos
que sofreram violações aos seus direitos
fundamentais no período ditatorial. A abordagem
buscará correspondências na metodologia da
corrente Direito e Literatura. O objetivo será
problematizar os instrumentos das instituições
do controle da sociedade, que esvaziam
qualquer traço de respeito aos direitos humanos
e à atuação legítima das instituições de justiça
social. Procurar-se-á, nesse contraste, colocar
em valor a produção, registro e disponibilidade
de fontes orais da história do passado recente,
como forma de garantir, ineditamente, o
seu acesso ao conjunto dos cidadãos e das
instituições de educação e direito. As ficções
literárias conquistam, malgrado a censura, um
contingente de leitores inimaginável e a obra
1984 é exemplar no sentido de democratizar a
informação da possibilidade da construção de
sociedades totalitárias em qualquer período.
Guardadas as proporções, essa busca de
evidenciar, por meio do artigo, um dos limiares
entre a ficção e a realidade de contextos de
Estados e de justiça de exceção pode ajudar a
oferecer ao leitor leigo, ao literato e ao jurista um
despretensioso instrumento de problematização
das temáticas aventadas.

Abstract:
This article will draw a critical and
comparative analysis between the dystopic
work 1984 and the testimonies given to the
Comissão Municipal da Verdade de Juiz de
Fora by people that suffered violation to their
fundamental rights in the dictatorial period. The
approach will base itself in the methodology
known as Law and Literature. The purpose is to
problematize the instruments of the institutions
of control of society that empties any trace of
respect to the human rights and to the legitimate
actuation of the institutions of social justice. It
is intended, in this contrast, to highlight the
generation, register and disposal of oral sources
of recent past as a way of ensure its access to
the citizens and institutions of education and law. The literary fiction accomplished,
despite of the censorship, an uncountable contingent of readers and the work 1984 is
an example in democratization of the information that totalitarian societies can be built
in any period. Preserving due proportions, the attempt to expose, using this article,
one of the thresholds between fiction and reality in the context of states and justice of
emergency can help offering the lay reader, the literate and the jurist an unpretentious
instrument of questioning of the raised themes.
