ENCARCERAMENTO EM MASSA NO BRASIL: A GUERRA ÀS DROGAS SOB A PERSPECTIVA DA CRIMINOLOGIA CRÍTICA
O presente artigo almeja estudar o encarceramento em massa no Brasil sob a ótica da criminologia crítica, ciência esta que busca, basicamente, entender o porquê de um grupo específico da sociedade ser considerado criminoso e alvo do poder punitivo estatal. A fim de identificar qual a ideologia do Sistema de Justiça Criminal brasileiro e qual a função da seletividade penal nos processos de criminalização, serão utilizados os métodos indutivos (e, portanto, qualitativo), estatístico, monográfico e, ainda, materialista histórico-dialético. Em suma, o que se pretende demonstrar neste artigo é o fato de que o encarceramento em massa é uma questão problemática no sistema de justiça criminal, ao passo que as instituições, que deveriam ser imparciais, atuam com base num racismo muito bem planejado e articulado ao longo dos anos. Assim, em um primeiro momento, a pesquisa objetiva recorrer à história para identificar a escolha da ideologia que constrói as estruturas sociais e, também, é utilizada pelo Sistema de Justiça Criminal brasileiro para punir; em um segundo momento, pretende-se investigar a relação da manutenção de uma política racista, a qual atua em prol das desigualdades baseadas na hierarquia racial, com o (falso) discurso de Guerra às Drogas e com a seletividade penal, recursos sistêmicos estes que mantêm essa estrutura social desigual.

Abstract:
The present article aims at studying mass incarceration in Brazil through the critical criminology lens, a Science that looks to, in essence, understand the reason why a specific group within a Society to be considered as criminals and become a target for punitive state power. In order to identiy which ideology of the Brazilian Criminal Justice System and what function of penal selectivity in the criminalization processes, the inductive method (and, as such, qualitative), statistical, monographic, and materialistic historical-dialectic. In summary, this article’s goal is to demonstrate the fact that mass incarceration is a problematic issue of the justice criminal system since institutions that should be impartial act on a racist basis that has been planned and well-articulated throughout the years.Thus, at first, a historical research identifies the ideological choice that builds social structures and, also, is utilized by the Brazilian Justice Criminal System to punish; secondly, it intends to investigate the relationship between the maintenance of a racist policy that acts in favor of the inequality based on racial hierarchy, with the (fake) stance on the War on Drugs and penal selectiveness, both systemic resources that maintain the unequal social structure.
