ENCARCERAMENTO EM MASSA: A REINVENÇÃO DA ESCRAVIDÃO
A temática
proposta orbita em torno da economia política penal como instrumento de
controle social. Nesse desiderato, o presente trabalho objetiva trazer uma
reflexão dinâmica, moderna, porém crítica, à situação do controle social e suas
graves consequências que se manifestam no sistema punitivo criminal e
desaguam no aprisionamento. O medo, o ódio, o estado animalesco a que
retrocedem muitos, (in) justamente por nada terem; enquanto outros o tem para
muito além do luxo. As prisões dos jovens e pobres por crimes relacionados ao
consumo/fetiche das drogas. A situação de lamúria e dor do cárcere brasileiro,
mais assemelhado a uma masmorra que a um instituto de ressocialização. A
compreensão de que o fenômeno do encarceramento em massa, sob o viés
neoliberal e neoconservador, se revela como um mecanismo de controle social
de classes étnicas e sociais despossuídas e para preservar e proteger a
hegemonia daquelas mais abastadas. Este trabalho visa plantar uma semente
reflexiva para que a intolerância transbordante não transforme o futuro em medo.
O desenvolvimento metodológico da obra se sustentou no marco teórico da
criminologia crítica, revolvendo-se em seus mais paradigmáticos pensamentos.
Substrato essencial para este trabalho é a visão de mundo como um processo
dinâmico a partir da práxis, vivida como engrenagem viva do Direito. Como
resultado este trabalho se propõe a galgar alguns degraus no pensamento crítico
decolonial latino-americano em busca da utopia saudável e necessária de que
uma nova sociedade é possível.

Abstract:
The proposed theme orbits
around the penal political economy as an instrument of social control. In this
regard, the present work aims to bring a dynamic, modern but critical reflection
to the situation of social control and its serious consequences that manifest
themselves in the criminal punitive system and lead to imprisonment. The fear,
the hatred, the animalistic state to which many fall back, (un) precisely because
they have nothing; while others have it far beyond luxury. Young and poor arrests
for drug-related / fetish-related crimes. The situation of lameness and pain in the
Brazilian jail, more similar to a dungeon than a resocialization institute. The
understanding that the phenomenon of mass incarceration, under the neoliberal
and neoconservative bias, reveals itself as a mechanism of social control of
dispossessed ethnic and social classes and to preserve and protect the
hegemony of the wealthier ones. This work aims to plant a reflexive seed so that
overflowing intolerance does not turn the future into fear. The methodological
development of the work was based on the theoretical framework of critical
criminology, revolving in his most paradigmatic thoughts. An essential substrate
for this work is the worldview as a dynamic process based on praxis, lived as the
living gear of law. As a result, this paper proposes to climb some steps in Latin
American decolonial critical thinking in search of the healthy and necessary
utopia of which a new society is possible.
