EFICÁCIA DOS DIREITOS FUNDAMENTAIS NAS RELAÇÕES EMPRESARIAIS PRIVADAS
O presente trabalho tem como
escopo a análise dos direitos fundamentais
em face as relações privadas, em especial as
pessoas jurídicas de direitos privados como
titulares destes direitos, e como tais direitos
incidem e afetam as pessoas jurídicas em
suas relações empresariais. Pois, as pessoas
jurídicas são consideradas sujeitos de direitos
fundamentais, mesmo que consagradas de
forma coletiva, visto que são representações
de pessoas físicas, e fazem parte da estrutura
empresarial, ou seja, atingi-las implica
necessariamente atingir também os indivíduos
que as compõem. Apresenta-se uma visão
panorâmica dos direitos fundamentais,
demonstrando a influência que as gerações de
direitos fundamentais exerceram na evolução
dos direitos individuais, descrevendo de
forma breve as diversas formas de atuação,
proteção, alcance e destinatários dos direitos
fundamentais, abordando também a utilização
das cláusulas gerais nos contratos entre
pessoas jurídicas e a incidência dos direitos
fundamentais sobre elas, bem como apontar
as considerações em relação as divergências
doutrinárias e do posicionamento do STF.

Abstract:
The present work has as scope
the analysis of the fundamental rights in the
face of the private relations, the legal entities
of private rights as holders of these rights,
and how such rights affect and affect the legal
entities in their business relations. For, the legal
entities are considered subjects of fundamental
rights, even if consecrated collectively, since
they are representations of individuals, and they
are part of the corporate structure, that is, to reach them necessarily implies also to the individuals that compose them. An overview
of fundamental rights is presented, demonstrating the influence that generations of
fundamental rights had on the evolution of individual rights, briefly describing the
various forms of action, protection, scope and addressees of fundamental rights, and
also addressing the use of general clauses in contracts between legal entities, as well
as to point out the considerations regarding doctrinal divergences and the position of
the Supreme Court.
