EDUCAR NO CÁRCERE: FUNDAMENTOS LEGAIS DA EDUCAÇÃO EM PRISÕES
O presente trabalho versa sobre a educação em estabelecimentos penais. O texto é parte de uma pesquisa maior, realizada durante um Trabalho de Conclusão de Curso, que se caracterizou por ser de abordagem qualitativa, descritiva, bibliográfica e de campo. O recorte, aqui apresentado, objetiva apresentar os aspectos legais da educação em espaços de privação de liberdade, destacando bases legais que subsidiam essa educação nos âmbitos internacional, nacional e estadual. Para tanto, foi realizada uma pesquisa bibliográfica e documental. Como resultados, constatou-se que ao longo dos anos a temática de educação nas prisões tem ganhado visibilidade no cenário legal. Observou-se que durante muitos anos as pessoas privadas de liberdade foram “esquecidas” no que tange à educação. Desse modo, a educação nos estabelecimentos penais pode ser considerada um “assunto recente” no cenário legal. Contudo, atualmente, vê-se esforços dos governos estaduais empregados no sentido de implementar e executar políticas públicas, que, aliadas à legislação nacional, favoreçam o desenvolvimento das atividades educacionais dentro dos espaços de reclusão.

Abstract:
The present work deals with education in penal institutions. The text is part of a larger research, a Final Paper, which was characterized by being of a qualitative, descriptive, bibliographic, and field approach. The purpose of this work was to investigate the prison education policies developed at the Gonçalo de Castro Lima Penitentiary, located in the city of Floriano-PI. The excerpt presented here is part of the theoretical body of the research, aiming to discuss the legal aspects of education in places of deprivation of liberty, highlighting the legal bases that subsidize this education at the international, national and state levels. As a result, it was found that over the years the theme of education in prisons has gained visibility in the legal scenario. It was observed that for many years people deprived of their liberty were “forgotten” with regard to education, since education in penal institutions can be considered a “recent issue” in the legal scenario. However, currently, it can be seen that state governments are making efforts to implement and execute public policies, which, together with national legislation, favor the development of educational activities within the confinement spaces.
