DIVULGAÇÃO NÃO CONSENSUAL DE IMAGENS: UMA ANÁLISE DA LEGISLAÇÃO BRASILEIRA E SUA (IN)EFICÁCIA NA PROTEÇÃO DA MULHER
O artigo apresenta a temática da pornografia de vingança no âmbito da violência de gênero. Objetiva-se analisar se o sistema de justiça brasileiro é eficiente para garantir a proteção da mulher, tendo em vista que se vive em uma sociedade patriarcal que limita e julga a liberdade sexual da mulher. Para tanto, o estudo analisou as especificidades desse tipo de violência contra o gênero sob uma perspectiva social e legal, analisando o atual tratamento dado para o mesmo no Brasil. Portanto, o presente artigo pretende, primeiramente, analisar as especificidades do crime da pornografia de vingança por meio de um estudo da doutrina e, a partir disso, buscar-se-á analisar o tratamento legislativo dado a esse tipo de crime no ordenamento Brasileiro. Dessa forma, almeja compreender se o referido tratamento dado a esse crime encontra-se tutelado de maneira satisfatória dentro do ordenamento nacional.

Abstract:
This article presents revenge porn as type of gender-based violence. The main objective of the study is analyze if the Brazilian justice system is being efficient in guaranteeing the protection of women against this violence considereing the patriarchal structure of the Brazilian society which is biased against the sexual freedom of women. In order to do that, the study analyzed the specificities of this type of violence against women from a social and legal perspective, while analyzing its legal treatment in the Brazilian legislation. Therefore, this article intends, first, to analyze the specificities of revenge porn in the criminal justic through a study of the national doctrine and, from that, to analyze the legislation directed to this type of crime in the Brazilian legal system. Finally, the study aims to conclude if the national legislation is adequately addressing the problem of this type of gender-based violence in the country.
