DISCURSO JURÍDICO CONTEMPORÂNEO: uma investigação sobre o erudito e o filosófico
O objetivo deste texto é investigar natureza da linguagem hermética utilizada pelos operadores do Direito em contraponto com a necessidade de simplificação da linguagem jurídica requerida pela Associação dos Magistrados do Brasil (AMB) e pelo Presidente do Superior Tribunal Eleitoral no ano de 2008, o Ministro Ayres Brito. O discurso erudito e rebuscado observado em textos jurídicos podem ser vistos como uma forma dar credibilidade ao jurista que o enuncia. O discurso erudito como um discurso que indica conhecimento acumulado pelo enunciador aponta para o passado e nesse entendimento a erudição tem estreita relação com a tradição, pela própria depuração do conhecimento que se realiza na tradição. Na segunda parte do texto discutiu-se conceitos de linguística nas obras Tractatus Logico-Philosophicu e Investigações Filosóficas de Wittgenstein por ser este um teórico largamente estudo em filosofia da linguagem no Direito

Abstract:
The purpose of this text is to investigate the nature of the hermetic language used by Law operators in contrast to the need to simplify the legal language required by the Association of Magistrates of Brazil (AMB) and the President of the Superior Electoral Court in 2008, Minister Ayres Brito. The erudite and elaborate discourse observed in legal texts can be seen as a way to give credibility to the jurist who enunciates it. The erudite discourse as a discourse that indicates knowledge accumulated by the enunciator points to the past and in this understanding, erudition has a close relationship with tradition, through the purification of knowledge that takes place in tradition. In the second part of the text, linguistic concepts were discussed in the works Tractatus Logico-Philosophicu and Wittgenstein's Philosophical Investigations because this is a theoretical study widely in philosophy of language in Law
