DIREITOS TERRITORIAIS: As lutas e as “batalhas” em busca de reconhecimento de direitos
O presente texto parte do debate na Licenciatura em Estudos Africanos e Afro-Brasileiros, pela Universidade Federal do Maranhão, desenvolvido na disciplina “Quilombos Maranhense” a cerca da temática direitos territoriais, para compreender os processos de regulamentação das terras intituladas de quilombos ou terras de pretos, desenvolvido do contexto de lutas e reivindicações em torno da terra, trazendo elementos dos avanços e retrocessos vividos pelos quilombolas em diferentes territórios. O debate girava também em torno de compreensão dos fatores e processos de regulamentação de terras, dentro da legalidade das questões jurídicas. Para tanto procuramos buscar autores que possam nortear tal pesquisa e colaborar com o debate a cerca de temática e também buscamos elencar os arcabouços jurídicos que foram implementados para essa regulamentação (ou Não regulamentação). Utilizaremos autores (as) como: O’DWYER (2008); MUNANGA (2003); DUTRA (2011); ROCHA, (2010); LEITE (2000). É imprescindível reescrever a página que foi arrancada da história junto com o próprio negro, história esta que não termina com a abolição. Vemos no cotidiano discurso como: “Aqui não vivem mais escravizados e, portanto não existem mais negros”, quando os mesmos foram deixados à própria sorte e hoje tem que lutar por um lugar não só na história, mas no território.

Abstract:
The present text starts from the debate in the Degree in African and Afro-Brazilian Studies, by the Federal University of Maranhão, developed in the discipline “Quilombos Maranhense” about the territorial rights theme, to understand the processes of regulation of the lands called quilombos or lands of blacks, developed from the context of struggles and claims around the earth, bringing elements of the advances and setbacks experienced by quilombolas in different territories. The debate also revolved around understanding the factors and processes of land regulation, within the legality of legal issues. Therefore, we seek authors who can guide such research and collaborate with the debate on the theme and also seek to list the legal frameworks that were implemented for this regulation (or non-regulation). We will use authors such as: O'DWYER (2008); Munanga (2003); DUTRA (2011); ROCK (2010); MILK (2000). It is essential to rewrite the page that was torn from history along with the black himself, which ends with the abolition. It is as if they said “Here no longer live slaves and therefore there are no more blacks” were played their own luck and today has to fight for a place not only in history, but in the territory.
