DIREITOS HUMANOS E ASPECTOS ÉTICOS: ALGUMAS INDAGAÇÕES ACERCA DA BIOÉTICA
A reflexão filosófica, ética e bioética,
propiciada com os novos paradigmas científicos,
traduz a complexidade das interfaces entre
a referida Bioética, o comportamento social
e o Direito. Analisar estas questões implica
em situar o escopo da Bioética e o seu
estatuto epistemológico. É de se considerar
que em primeiro plano deve situar-se o ser
humano valorado por si só, pelo exclusivo
fato de ser humano; isto é, a pessoa tem
sua irredutível subjetividade e dignidade,
decididamente dotadas de personalidade
singular. O entendimento sobre a dimensão da
operatividade dos direitos humanos e dos direitos
fundamentais permite os questionamentos
apontados pela Bioética. Como exemplo, em
matéria de reprodução humana assistida,
principalmente aquela relativa à fecundação in
vitro, ou às tormentosas questões vinculadas
à relação médico e paciente. Assumindo a
arriscada tentativa de alinhar respostas avante,
este texto apresenta essa reflexão, a partir de
indagações acerca de casos problemáticos
postos em evidência na atualidade.

Abstract:
The philosophical, ethical and
bioethical reflection, propitiated with the new
scientific paradigms, translates the complexity
of the interfaces between said Bioethics, social
behavior and Law. Analyzing these questions
implies situating the scope of Bioethics and its
epistemological status. It is to be considered
that in the foreground must be placed the
human being valued by itself, by the exclusive
fact of being human; that is, the person has his
irreducible subjectivity and dignity, decidedly
endowed with a singular personality. The
understanding of the dimension of the operability
of human rights and of fundamental rights
allows the questions pointed out by Bioethics.
As an example, in terms of assisted human
reproduction, especially that related to in vitro
fertilization, or to the stormy questions related
to the doctor and patient relationship. Assuming
the risky attempt to align answers onwards, this
text presents this reflection, based on inquiries
about problematic cases that are currently highlighted.
