No Brasil muito se fala acerca da

eficácia horizontal das relações privadas, tendo

como base a Constituição Federal brasileira

e a efetividade dos direitos fundamentais,

não somente às relações verticais, mas sim

horizontais. Como é de notório conhecimento os

Direitos Humanos são aplicados aos Estados,

nas relações verticais para proteger o indivíduo;

contudo a doutrina pouco aborda a questão de

aplicação desses direitos às relações privadas.

Logo, diante desta lacuna o presente artigo

teve como objetivo analisar a possibilidade

de aplicação dos Direitos Humanos nas

relações privadas e, igualmente, apresentar

os elementos sob a ótica da obra de Andrew

Clapham intitulada Human Rights in the Private

Sphere que fundamentam tal análise. Para tanto

foi utilizado o método de revisão bibliográfica

e dedutivo. O presente artigo diferencia os

Direitos Humanos de direitos fundamentais. Em

seguida verificam-se os elementos que Andrew

Clapham adota em sua obra que justificam esta

aplicação, contextualizando a para o Brasil.

Ainda analisa-se como ocorre a relação entre

Direitos Humanos e as relações privadas no

âmbito do Direito Internacional Público. Ao final,

demonstra-se que os Direitos Humanos podem

ser aplicados às relações privadas

Abstract:
In Brazil much is said about the

horizontal effectiveness (Third Party Effect) of

private sphere relations, based on the Brazilian

Federal Constitution and the effectiveness of

fundamental rights, but not only direct to vertical

relations, but as well to horizontal ones. As well

known, Human Rights are applied to states in

vertical relations to protect person (individual);

however the scholars don´t deal enought with

the effect of these rights in the private sphere

relations. Therefore, the aim of this paper is

analyze the possibility of applying Human

Rights in private sphere relations and likewise

present the elements, from the perspective of

the work of Andrew Clapham, entitled Human

Rights in the Private Sphere that underlies this

work. Therefore, the method of bibliographical

and deductive review was used. This article

distinguish human rights from fundamental

rights. Then the elements that Andrew Clapham

adopts in his work to justify its application are

contextualized to Brazil. It also analyzes how the

relationship between Human Rights and private

relations in the scope of Public International Law

occurs. In the end, it is shown that Human Rights

can be applied to private sphere relationship.
