Abstract: This academic article examines State liability towards the families of military personnel killed in the line of duty, focusing on fundamental rights and the legal protection of their dependents. It contextualizes the issue of state omission in providing due compensation, especially in high-risk operations in the Brazilian Amazon, where military activities expose agents to serious dangers. The article addresses the State's duty to protect service members and ensure proper reparation in case of death, in light of the theory of strict (objective) civil liability applicable to Public Administration. It discusses the fundamental rights at stake - notably human dignity and the special constitutional protection of the family - and how the lack of comprehensive support to bereaved families violates these principles. The study examines case law from the Brazilian Supreme Federal Court (STF) and Superior Court of Justice (STJ), highlighting current jurisprudential understandings, including the possibility of cumulating pension benefits with damages and the acknowledgment of the duty to indemnify in face of state omission. Finally, it proposes normative and interpretative solutions to ensure protection and compensation for the families of military personnel killed on duty, addressing gaps and aligning state action with the constitutional principles of human dignity and administrative efficiency.
