DIREITO SISTÊMICO E DIREITOS HUMANOS: A APLICAÇÃO DAS CONSTELAÇÕES FAMILIARES PARA TRATAMENTO DOS CONFLITOS JUDICIAIS
A sociedade exige o aprimoramento do sistema de justiça diante da complexidade do fenômeno da violência já que a aplicação da lei no sistema legalista não produz a harmonização dos conflitos. A necessidade social conduz à investigação sobre o denominado direito sistêmico que possui por núcleo as constelações familiares, atualmente adotadas por 13 tribunais brasileiros na resolução de conflitos judicializados. As constelações sistêmicas fenomenológicas conduzem a percepção de fatos gerados pelo campo morfogenético que armazena memórias do sistema familiar e transmite informações, direcionando comportamentos atuais. Investiga-se as denominadas leis sistêmicas identificadas pelo filósofo Bert Hellinger e que conduzem a consciência coletiva e submetem o campo familiar. A expressão direito sistêmico foi introduzida no cenário jurídico em 2006 pelo juiz brasileiro Sami Storch que inconformado com os limites do processo tradicional onde a prestação jurisdicional não é capaz de pacificar as partes e após o encerramento do processo o conflito permanece latente, amplia o olhar mergulhando na filosofia hellingeriana em busca de novos caminhos. Investigam-se neste estudo as características dessa abordagem na tentativa de estabelecer conexão com os direitos humanos, sendo possível verificar que sua exitosa aplicação renova a esperança numa justiça integral e num direito mais humanizado.

Abstract:
Society demands the improvement of the justice system in view of the complexity of the phenomenon of violence, since the application of the law in the legal system does not produce the harmonization of conflicts. The social need leads to the investigation of the so-called systemic law that has family constellations as its core, currently adopted by 13 Brazilian courts in the resolution of judicialized conflicts. The phenomenological systemic constellations lead to the perception of facts generated by the morphogenetic field that stores memories of the family system and transmits information, directing current behaviors. The so-called systemic laws identified by the philosopher Bert Hellinger are investigated and which lead to collective consciousness and subject in the family field. The term systemic law was introduced in the legal scenario in 2006 by the Brazilian judge Sami Storch, who disagreed with the limits of the traditional process where the judicial provision is not able to pacify the parties and after the end of the process, the conflict remains latent, widening the view in Hellinger's philosophy in search of new paths. The characteristics of this approach are investigated in this study in an attempt to establish a connection with human rights, and it is possible to verify that its successful application renews hope for integral justice and a more humanized right.
