Abstract: The present work aims to delve deeper into the conditions that allowed the creation and maintenance of a prison along the lines of the Guantánamo prison. The legality of the penitentiary complex is evaluated and how the international community faces such an affront to the fundamental rights of the citizen. The analysis is premised on the concept of Criminal Law of the Enemy in Günther Jakobs, goes through the chronology of his thought and how it concatenates with the extreme right narrative that spreads in several countries, mainly in the United States of America. The work goes through the problem of terrorism arising from radical Islamic fundamentalism and how it potentiates xenophobia on an increasing scale. Finally, it analyzes the legality of the Guantánamo prison, based on human rights treaties, decisions of the US Supreme Court, decisions at the federal level and laws implemented in times of war.
