Direito humano fundamental à educação
O presente trabalho tem por
intuito analisar a maneira na qual o direito à
educação foi sendo abordado no ordenamento
jurídico brasileiro. A proposta é tratar o direito
à educação no plano jurídico internacional e
nacional. Na primeira dimensão, o objetivo é
elucidar a identificação do direito à educação
no plano jurídico internacional como, a
previsão em tratados internacionais. Já na
dimensão nacional, há o delineamento da
sua multidimensionalidade no ordenamento
jurídico nacional, bem como uma análise sobre
a formulação da organização da educação
brasileira a partir da Constituição Federal de
1988 e da Lei de Diretrizes e Bases da Educação
de 1996.

Abstract:
This paper aims to analyse the
way that the right of education has been treated
in the Brazilian judicial system. It is proposed
to approach both national and international
levels of right of education. First, it is focused
on identifying the right of education in the
international level, such as international treaties.
Then, at national level, there is the outlining
of the multidimensionality of national judicial
system, as well as an analysis about how the
Brazilian’s education is organized from the
Federal constitution of 1988 and from the “Lei
de Diretrizes e Bases da Educação” of 1996.
