DIREITO E MULTICULTURALISMO: O RESPEITO Á DIVERSIDADE CULTURAL DOS INDÍGENAS NO BRASIL
Esta pesquisa pretende analisar brevemente o que é cultura e diversidade cultural, a conjuntura europeia durante o período de colonização, além da proteção da cultura indígena no ordenamento jurídico brasileiro e o respeito ao multiculturalismo. Constata-se que, não somente a Constituição Federal de 1988, como também todo o aparato legislativo busca preservar a diversidade cultural presente no território brasileiro, embora ainda haja resquícios do processo de colonização no qual a cultura indígena fora marginalizada, gerando uma segregação do índio na sociedade contemporânea. A metodologia utilizada é dedutiva e o procedimento é monográfico histórico.

Abstract:
This research intends to analyze briefly what culture and cultural diversity is, the European conjuncture during the colonization period, besides the protection of the indigenous culture in the Brazilian legal system and the respect for multiculturalism. It is noted that not only the 1988 Federal Constitution, but also the entire legislative apparatus seeks to preserve the cultural diversity present in Brazilian territory, although there are still remnants of the colonization process in which indigenous culture had been marginalized, generating a segregation of the Indian in contemporary society. The methodology used is deductive and the procedure is historical monographic.
