DIREITO E ARTE: A PERFORMANCE RHYTHM 0 DE MARINA ABRAMOVIC E O PRINCÍPIO DA INDISPONIBILIDADE DA VIDA
Vida e arte se encontram o tempo
todo, ora, vida e arte se misturam, uma imita a
outra. Entretanto, existem momentos que vida
e arte colidem, tal qual a performance Rhythm
0 de Marina Abramovic, onde a vida da artista é
posta em risco e por pouco não é cessada em
meio a performance. Marina se propõe a testar
os limites do corpo e da relação público-artista
por meio de sua obra e assim o faz em Rhythm
0. Mas, em meio a essa performance Abramovic
atinge o limite, aproximando-se da morte. Nesse
panorama de limites que acrescento o Direito
a discussão, especificamente o Direito Penal
brasileiro, pois, vida é bem jurídico indisponível.

Abstract:
Life and art meet all the time,
sometimes, life and art mix, one imitates the
other. However, there are moments when life
and art collide, just like Marina Abramovic's
Rhythm 0 performance, where the artinst life is at
risk, almost ceased in the midst of performance.
Marina proposes to test the limits of the body
and the public-artist relationship through her
work and so does Rhythm 0. But in the midst of
this performance Abramovic reaches the limit,
approaching her self to death. In this ambient
of limits that I add law to discussion, specifically
the Brazilian Criminal Law, therefore, life is legal
material unavailable.
