DIREITO E A CATEGORIZAÇÃO SEXUAL: UMA ANÁLISE SOCIO-JURÍDICA SOBRE A CONSTRUÇÃO DE UM DIREITO NOVO
O presente estudo tem como objeto a possibilidade do Direito ser um instrumento de subversão à lógica de poder colonizadora de corpos pautada em categorias sexuais. O artigo está estruturado em três seções com o fim de responder à seguinte pergunta: em que medida o Direito pode ser um instrumento de subversão às relações de poder colonizadoras dos corpos dos indivíduos, no âmbito das categorias sexuais? Para tanto, em um primeiro momento, analisou-se a articulação das relações de poder com o Direito, dando-se ênfase à imagem do Direito normalizado-normalizador, destacado por Fonseca (2002), à luz da teoria de Michel Foucault. Posteriormente, averiguou-se a relação do poder com as identidades sexuais, discutindo-se a criação e instrumentalização das mesmas como elementos de controle de corpos e de modos de vida; refletindo-se sobre o atravessamento do Direito pela citada lógica identitária e, conseqüentemente, sobre a sua contribuição para a colonização de corpos, fazendo necessária a reflexão sobre um Direito Novo. Por fim, em um terceiro momento, analisou-se a criação de uma nova ordem sexual, transcendente às identidades, à luz, principalmente, dos conceitos de performatividade de Judith Butler e de arte de viver sexual de Michel Foucault, refletindo-se sobre a possibilidade do direito ser um dos instrumentos dessa nova ordem.

Abstract:
The present study aims at the possibility of Law being an instrument of subversion to the logic of colonizing power of bodies based on sexual categories. The article is structured in three sections in order to answer the following question: to what extent can Law be an instrument of subversion to the relations of power colonizing the bodies of individuals within the sexual categories? In order to do so, at first, the articulation of the relations of power with the Law was analyzed, emphasizing the image of norm-normalizing law, highlighted by Fonseca (2002), according Michel Foucault's theory. Subsequently, the relationship of power with sexual identities was investigated, discussing the creation and instrumentalization of the same as elements of control of bodies and ways of life; reflecting on the crossing of the Law by the said identity logic and, consequently, on its contribution to the colonization of bodies, making necessary the reflection on a New Right. Finally, in a third moment, we analyzed the creation of a new sexual order, transcendent to the identities, according, mainly, of the concepts of performativity of Judith Butler and art of sexual living of Michel Foucault, reflecting on the possibility of the Law being one of the instruments of this new order.
