Abstract: This article investigates the right to be and live in Early Childhood Education, emphasizing the appreciation of individuality and the fight against prejudice as essential elements for the holistic development of children from their earliest school years. The general objective is to analyze how this right can be guaranteed in Early Childhood Education by promoting inclusive and respectful environments that value children's uniqueness. The specific objectives are to recognize educational needs that ensure children’s free expression; understand the role of inclusive pedagogical practices in strengthening identity and social coexistence; and analyze the importance of ethical and affective educator training in fostering a welcoming and democratic school environment. The applied methodology consists of qualitative research based on bibliographic review and documentary analysis, enabling critical reflection on pedagogical practices and public policies related to Early Childhood Education. This study engages with key authors such as Paulo Freire (1996), who highlights the educator's role as an agent of transformation; Newton Duarte (2007), who addresses the construction of individuality in childhood; and Maria Teresa Mantoan (2003), a reference in inclusive practices. It is also grounded in the National Guidelines and Framework Law for Education (Brazil, 1996), which guides Early Childhood Education development in the country. It is expected that this research will contribute to strengthening the appreciation of the right to be and live in childhood, encouraging educators and administrators to adopt inclusive pedagogical practices that promote respect for diversity and the formation of a more just, ethical, and democratic society.
