Abstract: The advancement of artificial intelligence introduces new challenges for image rights and copyright, with technologies like deepfakes enabling realistic image manipulation without consent. This context broadens the debate on privacy and authorship, intensifying the need for regulation. In response, Bill 4025/23 proposes changes to the Civil Code and the Copyright Law, requiring express authorization for the use of images of individuals, living or deceased, in AI systems. It also stipulates that human-authored works require prior permission for AI training and excludes copyright for creations made exclusively by artificial systems. Volkswagen’s recent campaign, which used the image of singer Elis Regina, underscores the urgency of this debate, raising ethical questions about the integrity of public figures. Thus, the bill seeks to balance innovation with the protection of personality and creative rights.
