DIREITO DA PESSOA COM DEFICIÊNCIA NA EDUCAÇÃO
Este artigo objetiva-se em compreender as alterações das leis brasileiras que garantem às
pessoas com deficiência o direito à educação de forma adequada, respeitosa, legal e de qualidade, onde
todas nas suas diversas peculiaridades, tais como: deficiência física, auditiva, visual, mental e outros
transtornos psicológicos como autismo, dentre outros, possam ser atendidos nas salas de aulas com a
presença de profissionais qualificados para cada especificidade, garantindo o direito do sujeito com
deficiência de ser um cidadão igual aos demais no usufruto de seus direitos fundamentais perante a Carta
Magna e sociedade. Assim, a metodologia utilizada foi a pesquisa qualitativa bibliográfica por meio da
leitura de livros, constituições, Estatuto da pessoa com deficiência, Lei nº 13.146/2015, artigos científicos
e outros materiais. Destarte, os resultados são os direitos fundamentais, especialmente a educação garantida
pela Constituição de 1988 e as Leis de Diretrizes e Base – LDB para melhoria da qualidade de vida e
inclusão das pessoas com deficiência à sociedade, por entender que os espaços e as instituições que devem
se adequarem a heterogeneidade de seus cidadãos e nãos cidadãos a sociedade e seus respectivos espaços.

Abstract:
This article aims to understand the changes in Brazilian laws that guarantee people with
disabilities the right to education in an adequate, respectful, legal and quality way, where all of their
different peculiarities, such as: physical, hearing, visual, mental disorders and other psychological disorders
such as autism, among others, can be attended in classrooms with the presence of qualified professionals
for each specificity, guaranteeing the right of the person with a disability to be a citizen equal to others in
the enjoyment of their fundamental rights before the Magna Carta and society. Thus, the methodology used
was qualitative bibliographic research through the reading of books, constitutions, the Statute of the
Disabled Person, Law No. 13,146/2015, scientific articles and other materials. Thus, the results are
fundamental rights, especially education guaranteed by the 1988 Constitution and the Laws of Guidelines
and Base - LDB to improve the quality of life and inclusion of people with disabilities in society,
understanding that spaces and institutions that they must adapt to the heterogeneity of their citizens and
non-citizens to society and their respective spaces. -
