DIREITO CONSTITUCIONAL COMPARADO: ANÁLISE DOS DISPOSITIVOS PROTETIVOS DOS ANIMAIS NÃO HUMANOS NO ÂMBITO DE ALGUNS ESTADOS-NAÇÕES
Objetiva-se neste estudo analisar as Constituições de alguns Estados-nações na busca por dispositivos protetivos dos animais não humanos. Trata-se de um estudo qualitativo, básico, descritivo, documental e bibliográfico em que se realizou a seleção e leitura das Normatizações Constitucionais de alguns Estados-nações e das literaturas disponíveis atinentes à temática protetiva dos animais não humanos, bem como organização das informações coletadas e análise e discussão das mesmas. E no que diz respeito a perspectiva teórica priorizada assenta-se na investigação crítica. Os resultados apontam que existem três níveis diferenciados de proteção dos animais não humanos dentro dos respectivos Arcabouços Constitucionais dos seis Estados-nações aqui analisados. Estes níveis são caracterizados como: (i) proteção genérica como é o caso do Brasil, Equador, Alemanha e Suíça; (ii) proteção genérica complementada com uma proteção especial de animal considerado sagrado e neste campo situa-se a Índia e (iii) proteção dos animais submetidos à atividade econômica como por exemplo um Ente Federativo dos Estados Unidos da América, o estado da Flórida. Conclui-se que, não obstante, a existência de níveis diferenciados de proteção, os animais não humanos ocupam espaço no interior das Constituições de alguns Estados-nações.

Abstract:
The objective of this study is to analyze the Constitutions of some nation-states in the search for protective devices for non-human animals. This is a qualitative, basic, descriptive, documentary and bibliographic study in which the Constitutional Regulations of some nation-states and the available literature related to the protection of non-human animals were selected and read, as well as the organization of the collected information. and their analysis and discussion. And with regard to the prioritized theoretical perspective, it is based on critical investigation. The results indicate that there are three different levels of protection for non-human animals within the respective Constitutional Frameworks of the six nation-states analyzed here. These levels are characterized as: (i) generic protection as is the case in Brazil, Ecuador, Germany and Switzerland; (ii) generic protection complemented with a special protection of animal considered sacred and in this field is located in India and (iii) protection of animals subjected to economic activity as for example a Federal Entity of the United States of America, the state of Florida. It is concluded that, despite the existence of different levels of protection, non-human animals occupy space within the Constitutions of some nation-states.
