DIREITO AO FUTURO: A PROJEÇÃO DA NORMA JURÍDICA NO TEMPO
Este artigo objetiva analisar a norma jurídica sob o enfoque de sua realização no futuro, considerando-a como elemento intrínseco ao comando legal cuja interpretação de conteúdo jurídico deve se fazer projetada no tempo. A partir da CF/88, propomos que a análise da prestação do Estado frente à sociedade, principalmente no que diz respeito aos direitos fundamentais, seja feita mediante a chave hermenêutica que determina ao Poder Público atuar para alterar o status quo das desigualdades social e econômica. Utilizando o método dedutivo, concluímos que o comando constitucional que determina o desenvolvimento social não tem sido observado no Brasil

Abstract:
This article aims to analyze the rule of the law’s theory on its implementation point, considering not just its efficacy, but also as an element intrinsic to the legal command, whose legal content interpretation, must be projected through time. Considering that some fundamental rights are denied to an expressive portion of the population – creating differents categories of citizens towards the State – it is proposed to read the legal provision, when regulating fundamental rights, as a Right that must be observed by the State’s service that will be realized, in the future, as an element of citizen status changing
