DIREITO A VACINAÇÃO EM TEMPOS DE PANDEMIA: RESPONSABILIDADE CIVIL DO ESTADO
A pesquisa tem o objetivo de verificar em que medida poderá ocorrer à responsabilidade civil do Estado por ação ou omissão como também pelas ações tardias na aquisição das vacinas e na imunização da população. Apresentam-se quatro capítulos, sendo a base introdutória; no segundo capítulo aborda-se sobre a saúde como dever do Estado com ênfase na necessidade de se estabelecer um plano efetivo de imunizações a nível nacional; no terceiro capítulo destaca-se a competência dos entes federados no tocante a saúde, demonstrando os posicionamentos legais, doutrinários e jurisprudenciais; o quarto capítulo traz a responsabilidade civil do Estado, destacando em fase conclusiva que se houver comprovação de ação ou omissão por qualquer ente Federado, em especial no tocante à vacinação, poderá haver a responsabilização, respeitadas as devidas competências. Será utilizado o método teórico-bibliográfico, sendo a abordagem realizada através do método dedutivo e dialético, partindo-se da realidade atual, demonstrando o avanço da pandemia e o direito da população as vacinas através do plano nacional de imunizações.

Abstract:
The research has the objective of verifying to what extent the State's civil liability for action or omission may occur, as well as for the late actions in the acquisition of vaccines and in the immunization of the population. Four chapters are presented, being the introductory basis; the second chapter deals with health as a duty of the State with an emphasis on the need to establish an effective immunization plan at the national level; in the third chapter, the competence of the federated entities in terms of health is highlighted, demonstrating the legal, doctrinal and jurisprudential positions; the fourth chapter brings the civil liability of the State, highlighting in a conclusive phase that if there is evidence of action or omission by any Federated entity, especially with regard to vaccination, there may be liability, with due regard for the appropriate competencies. The theoretical-bibliographic method will be used, and the approach will be carried out using the deductive and dialectical method, starting from the current reality, demonstrating the advance of the pandemic and the population's right to vaccines through the national immunization plan
