DIREITO À PROCRIAÇÃO E OS OBSTÁCULOS SÓCIO-JURÍDICOS ADVINDOS PELA GESTAÇÃO POR SUBSTITUIÇÃO
Pela tenacidade do processo de inovação tecnológica, muitos problemas e lacunas acometem as sociedades contemporâneas, além de gerar uma possível obstacularização na luta pelos direitos humanos. Por esse viés, o presente trabalho terá como finalidade traçar uma análise a respeito do direito à procriação, fazendo um recorte na técnica de reprodução assistida titulada como Gestação por Substituição. Pretende-se evidenciar a necessidade de uma legislação específica ao tema, pois as imprecisões na tutela desse ato da vida vêm abrindo margem para decisões antagônicas à máxima efetivação da dignidade da pessoa humana, diante da “ética da dominação” que impulsiona, dessa forma, a promoção de uma agenda conservadora e, de certo modo, punitivista.

Abstract:
Due to the tenacity of the technological innovation process, many problems and gaps affect contemporary societies, besides generating a possible obstacle in the struggle for human rights. By this bias, the present work will draw an analysis about the right to procreation, making a cut in the assisted reproduction technique titled as Gestation for Substitution. The aim is to highlight the need for specific legislation on the subject, because the inaccuracies in the protection of this act of life have been making room for antagonistic decisions to the maximum realization of the dignity of the human person, in face of the “ethic of domination” that thus drives the promotion of a conservative and somewhat punitive agenda.
