DIREITO À MORADIA: UMA ANÁLISE DO SOB A ÓTICA DO BEM VIVER NO DIREITO URBANÍSTICO EM SALVADOR/RIO DE JANEIRO.
Preliminarmente deve-se apurar a gêneses da categoria jurídica do direito à moradia, a fim de que sejam mapeadas a sua formação histórica e, consequentemente, analisar os problemas que surgiram em diversos momentos. Após breve avaliação, discute-se seus limites no contexto em que exsurgiram, tomando como ponto de partida as constantes lutas sociais por moradias em seu sentido mais amplo. Por fim, transitando pela problemática urbanística da cidade de Salvador e do Rio de Janeiro, observa-se a possibilidade de inserção de uma nova ordem social de garantia do direito à moradia, a qual se traduz pelos pilares do conceito do bem-viver, cujos conceitos e princípios ainda precisam ser devidamente construídos.

Abstract:
Preliminarily, the origin of the legal category of the housing law must be investigated, so that its historical formation can be mapped and, consequently, to analyze the problems that have arisen at different times. After a brief evaluation, their limits are discussed in the context in which they have emerged, taking as a starting point the constant social struggles for housing in its broadest sense. Finally, moving through the urban problems of the city of Salvador and Rio de Janeiro, there is the possibility of inserting a new social order to guarantee the housing law, which is translated by the pillars of the concept of good living, whose concepts and principles still need to be properly constructed.
