DIGNIDADE DA PESSOA HUMANA DA POPULAÇÃO LGBTQIA+ E SUA (IN)APLICABILIDADE AO SISTEMA PRISIONAL BRASILEIRO
Este artigo tem como objetivo apresentar considerações sobre a dignidade da pessoa humana da população LGBTQIA+ enquanto privados de liberdade. Sem o objetivo de formular um tratado, tecendo posições doutrinárias e legislativas sobre o assunto, este trabalho tem como proposta traçar premissas para ulteriores desdobramentos, levando-se em consideração que no Brasil as políticas públicas em prol população LGBTQIA+ privada de liberdade ainda são incipientes, tampouco há discussões efetivas sobre o respeito a sua dignidade humana. Assim, por intermédio de pesquisas bibliográficas, buscou-se fomentar a discussão sobre sua vulnerabilidade e marginalização que se perpetua no tempo. Concluiu-se, portanto, que o sistema prisional reitera as desigualdades da população LGBTQIA+. Sua vulnerabilidade social é transformada em equação múltipla de direitos fundamentais feridos. A dignidade da pessoa humana é vilipendiada quando seu detentor é membro da população LGBTQIA+, pois há intransigência institucional e da massa carcerária na aceitação da orientação sexual do detento.

Abstract:
This article aims to present considerations about the dignity of the human person of the LGBT population while deprived of liberty. Without the objective of formulating a treaty, weaving doctrinal and legislative positions on the subject, this paper aims to outline premises for further developments, taking into account that in Brazil public policies in favor of lgbt population deprived of liberty are still incipient, nor are there effective discussions on respect for their human dignity. Thus, through bibliographic research, we sought to foster the discussion about their vulnerability and marginalization that is perpetuated in time. It was concluded, therefore, that the prison system reiterates the inequalities of the LGBT population. Their social vulnerability is transformed into a multiple equation of wounded fundamental rights. The dignity of the human person is vilified when its holder is a member of the LGBT population, because there is institutional intransigence and the prison mass in the acceptance of the sexual orientation of the detainee.
