Desvelando o Novo Código de Processo Civil a partir de um estudo Sócio-Filosófico do Direito: uma leitura a partir da Conflitologia e sua justaposição contextual e textual
O artigo busca uma nova
perspectiva do Processo Civil ao Direito a partir
das discussões que o NCPC traz, que fazem
repensar a função do Processo Civil ao Direito,
principalmente no que toca à construção do
Direito por via do Poder Judiciário, partindose
da necessidade do desvelar de sua textura
textual, de um lado, e a contextual, do outro;
contexto este dado pelo caso concreto como
fenômeno. O estudo transdisciplinar do direito
desvela os contextos sociais e com os sentidos
contextuais postos em análise, seguido da
busca dos sentidos da construção dos textos
e a busca por uma missão atual do Processo
Civil. Necessário se mostra uma análise
da conflitologia, a qual vem a dinamizar a
produção do Direito frente aos contextos e os
textos, sendo que pelo contexto, este vem a
dinamizar as estruturas e, de outro lado, pelo
texto, fornece as funcionalidades do Direito. O
texto abre espaços para novas interpretações
hermeneutizáveis de tal atmosfera estática, que
produz uma compreensão mais adequada para
a formulação de um Direito vivo.

Abstract:
The search to visualize a new
perspective of the Civil Procedure to the law
from the discussions that the NCPC brings,
that make rethink the function of the Civil
Procedure to the law, mainly in what concerns
the construction of the law through the Judiciary
Power, starting it is necessary to unveil its textual texture, on the one hand, and the
contextual, on the other; context given by the concrete case as a phenomenon. The
transdisciplinary study of the law reveals the social contexts and contextual senses that
are being analyzed, followed by the search for the meanings of the construction of the
texts and the search for a current Civil Procedure mission. It is necessary to show an
analysis of conflict, which is to dynamize the production of the law in relation to contexts
and texts, and through the context, this comes to streamline the structures and, on the
other hand, through the text, provides the functionalities of Law. The text opens spaces
for new hermeneutizable interpretations of such static atmosphere, which produces a
more adequate understanding for the formulation of a living Law.
