DESMISTIFICANDO UM CLAMOR SOCIAL CRIMINOSO E CRIMINALIZANTE
O presente trabalho buscará analisar a relação conflituosa entre clamor social e direitos individuais, a partir de um caso concreto. O estudo se propõe estabelecer uma discussão interdisciplinar entre Direito, Sociologia e História. Na discussão sobre os aspectos jurídicos, foram utilizados os conceitos de aborto legal e direito a intimidade e privacidade. Na análise do discurso sobre a violência sofrida pela vítima, foi utilizado conceitos referentes a relações de gênero e violência contra a mulher. Ao observar o discurso presente nos grupos fundamentalistas, a partir de uma ótica de gênero, percebe-se que ele serve a uma função de proteção da estrutura patriarcal e da dominação sobre a mulher, em especial, sobre o seu corpo. Também, diante da análise da legalidade dos procedimentos efetuados, observa-se que a voz do clamor social ignora a legislação nacional, base do Estado Democrático de Direito, constituindo um discurso criminoso e criminalizante.

Abstract:
The present work will seek to analyze the conflicting relationship between social outcry and individual rights, based on a specific case. The study aims to establish an interdisciplinary discussion between Law, Sociology and History. In the discussion on legal aspects, the concepts of legal abortion and the right to intimacy and privacy were used. In the analysis of the discourse on violence suffered by the victim, concepts related to gender relations and violence against women were used. When observing the discourse present in fundamentalist groups, from a gender perspective, it is perceived that it serves a function of protecting the patriarchal structure and domination over women, especially over their bodies. Also, in view of the analysis of the legality of the procedures carried out, it is observed that the voice of social outcry ignores national legislation, the basis of the Democratic Rule of Law, constituting a criminal and criminalizing discourse.
