Abstract: When a woman takes action and does not lower her head in the face of inequalities, without even realizing it, she defends all women, this moves society. With this humanizing essence, the object of this research is the incarcerated woman assisted in the state of Epirito Santo. From the point of view of important authors such as Teixeira (2017), Santoro and Pereira (2018), a bibliographical research was carried out, with qualitative analyzes on the organized material. The overall objective is to analyze studies on gender inequality in the prison system. Being the specific ones, knowing about prison in Brazil and its current conditions, researching gender inequality in society and its consequences, identifying from scientificity the contemporary situation of female prison and the situation of women inserted in it. The development was organized in three chapters, namely: Prison in Brazil and in the State of Espirito Santo; Female Prison System; Gender inequality in society and prison. The results achieved revolve around findings from the reflections stimulated by the various theoretical frameworks gathered and deepened in the present research, demonstrating that women in society still find a systemic and structural concept, above all the finding of the absence of humanization and fragility in the guarantee of the rights of imprisoned citizens. In a specific panorama of women's prison in Espírito Santo, it is possible to evidence an even greater gender inequality in terms of disrespect for the problems faced by incarcerated women. Concluding that there is no other way to minimize attacks on the constitutional rights and citizenship of any woman, except through the path of scientific knowledge, organization and social struggle, and the defense and improvement of the Brazilian constitution.
